			<content:encoded><![CDATA[<p>WICHITA — <strong>Cummings &amp; Cummings</strong> is once again going to have a Cummings and a Cummings.</p>
<p><strong>Bill</strong> and <strong>Nika Cummings</strong> started the law firm, which is at 129 E. Second St., in 1998. Nika Cummings left more than four years ago to work as a public defender. Now, she’s returning.</p>
<p>“She’s had really great success as a public defender,” Bill Cummings says of his wife.</p>
<p>She first worked for the Sedgwick County public defender’s office and then the county’s conflict office.</p>
<p>Cummings says his wife won 10 acquittals out of her last 12 cases, “which is just unheard of really.”</p>
<p>When Nika Cummings previously was at the firm, she worked part time there and as Mulvane’s prosecutor while also raising the couple’s four children. Once the kids were in school, she began her full-time public work.</p>
<p>Now, Bill Cummings says, his wife would like to try private practice again – and have the often more lucrative salary that accompanies it.</p>
<p>It’s fine by him, especially since they regularly confer about cases anyway.</p>
<p>“She’s just really good at what she does,” Cummings says. “She’s not only persuasive in the courtroom but … the office as well.”</p>

<p>Ignition interlock devices are instruments that usually have to be installed within a motor vehicle that requires the driver to blow into it in order to get the driver’s blood alcohol content, or BAC. If the BAC results show that the driver is under the influence the car will not start. Most individual’s initial thought is “Oh that does not sound so bad, I mean it is saving lives rights?” One can easily assume that the devices help contribute to getting some DUI offenders off the road, but an ignition interlock device is just like a breathalyzer and has been known to easily produce faulty results.</p>
<p>A study was done with the device and then compared to that of a normal breathalyzer, which showed both had a large room for error most of the time. These devices are meant to pick up and read an individual’s breath in order to see the alcohol content. However, the majority of the time it picks up an individual’s entire breath, which happens to be what they had for lunch, that afternoon snack they got out of the vending machine, or even just a simple piece of gum.</p>
<p>Ignition interlock devices serve the purpose of trying to rehabilitate individuals with past DUI discrepancies back out on the road. We may physically or emotionally change on a day-to-day basis or over a period of time, but either way we constantly experience change in one form or another. One thing that individuals come to meet at one point in their lives is that of becoming sick and the possibility that it could affect their lives in both positive and negative aspects. When an individual has diabetes many things in their life begins to change whether it is what they are eating or how much exercise they are participating in.</p>
<p>However, does your diabetes contribute to the possibility that you could get a DUI charge? One such incident occurred recently that proved to show the issue that diabetes can easily be mistaken as drunk driving. A man was driving home and began to swerve on the road since his blood sugar levels were becoming low. Officers then mistook the man as a drunk driver and proceeded to pull him over. From there, the man was asked to proceed in a field sobriety test, which he agreed to regardless of the fact he felt faint and awful now. At one point during the examination he began to have a diabetic seizure. The police then assumed the man was either trying to flee the seen and/or attack them and began to hit the man.</p>
<p>The man suffered from minor injuries from the attack, but now has to wear an insulin pump as a result from not being treated in a timely manner during his diabetic seizure. Many cases can be seen that individuals with diabetes are easily mistaken for drunk drivers when actually operating their vehicles on the road. However, their motor and communication skills give absolutely no indication that they have been drinking or using any drugs at all.</p>
<p>The health of an individual is something that is important now and later. When you are falsely accused of drinking and driving it is important to make sure that you make sure any health related issues are addressed to make sure that your innocence stands firm and solid. Studies have shown that cold medicines, and other drugs can easily render an individual incapable to drive and have them swerving in and out of lanes recklessly.</p>

Each part greatly curbs and shapes future decisions a person can come in contact with. However, what happens when an individual does not expect some variables?</p>
<p>Law enforcement officers usually plan on their main mission when first coming into the playing field to be that of protecting the public and serving justice. One can only assume that criminals would be the logical choice an officer would be protecting the innocent from. However, most of the cases that law enforcement officers come into contact with is that of alcohol and individuals driving under the influence of it.</p>
<p>Usually, alcohol is the culprit of a DUI charge, but recently drugs have been the common cause of individuals receiving not only DUI charges, but also that of possession. Law enforcement officers usually do not expect that the person that they are pulling over not only is under the influence of some substance and probably has the substance within the vehicle, but also what the individual is capable of doing on such a substance.</p>
<p>Drugs tend to up the playing field for officers and DUI investigations due to the fact of the type of drugs that are made available to citizens today. Ranging from illegal drugs to that of prescription drugs all of these various forms have different side effects and work with the actual genetic makeup of an individual. Alcohol though only usually slows an individual down physically and mentally.</p>

However, it’s once again that time of year that people are spreading the Christmas cheer, which means donations for charities, and present buying for kids, family, and friends. With so many things that have to be done for the one’s we love, and appreciate one can only hope that nothing will come out of the blue that would impact their happiness, guess again.</p>
<p>Law enforcement today is known by many to be corrupt, but even with giving a DUI charge, which could result in the conviction of an individual. Recently, an incident of this caliber erupted in Topeka, which ended up being a prime example of the faults within law enforcement.  Recently, police in Topeka stopped the vehicles that were heading northbound since the area was known as having “many” drunk drivers.</p>
<p>However, results showed that only one driver was arrested for being “drunk” behind the wheel of the vehicle, but many were left upset, and late from being investigated for no apparent reason. Out of hundreds of people, the law enforcement within that area of Kansas showed that the tax dollars of thousands within the area went to catch one person, that reports still state have not been solidified as being drunk driving.</p>
<p>The tax dollars of the public are important, which people work diligently for to make sure that they have a steady income coming in only the have the government dip in it for the “necessary” needs of the public. Yet, how many officers were paid for this checklane incident, how many vehicles were used that needed gas, and how much equipment was used? These all add up greatly as to where our tax dollars go, which could be used for more positive successful things such as community efforts, or known criminal offenders that law enforcement could not only make areas better, but the state as a whole.</p>
